Deduction of Legal Fees Following a Personal Injuries Claim

If you have been represented in a personal injuries claim by way of a Conditional Fee (often called a "No Win, No Fee") Agreement dated on or after 1st April 2013 your solicitors are entitled to deduct their success fee from your damages. In some case they are also entitled to deduct any part of their basic fee that has not been recovered from your opponent. The rules in relation to how these deductions are calculated are complex, and in our experience some solicitors get the calculation badly wrong and deduct far too much.
